§ 1 Scope

These General Terms and Conditions (GTC) apply to the sale of handcrafted chickens through www.amisdeplumes.com (hereinafter “Seller”) to consumers (hereinafter “Buyer”).

§ 2 Conclusion of Contract

The purchase contract is concluded through the Buyer’s order and the Seller’s acceptance. The Buyer’s order can be placed on the website or via email. The Seller accepts the Buyer’s order by providing a written order confirmation.

§ 3 Prices and Payment Terms

The prices for the handcrafted chickens are quoted in Swiss Francs (CHF) (and include VAT if applicable; please adjust accordingly). The purchase price is due upon conclusion of the contract and can be paid via PayPal or credit card. The Buyer is in default if the purchase price is not paid within 14 days of the due date.

§ 4 Delivery

The handcrafted chickens will be shipped by the Seller within 14 days of the conclusion of the contract to the delivery address provided by the Buyer. Shipping costs are included in the price. The risk of accidental loss or accidental damage of the handcrafted chickens passes to the Buyer or a recipient designated by the Buyer upon delivery.

§ 5 Right of Withdrawal

The Buyer has the right to withdraw from the purchase contract within 14 days of receiving the handcrafted chickens without giving reasons. The withdrawal period begins on the day the Buyer or a third party designated by the Buyer, who is not the carrier, takes possession of the handcrafted chickens. To exercise the right of withdrawal, the Buyer must send a clear statement via email (info@amisdeplumes.ch) informing the Seller of their decision to withdraw from the contract.

To meet the withdrawal deadline, it is sufficient for the Buyer to send the withdrawal notice before the withdrawal period expires. Consequences of withdrawal:
a. If the Buyer withdraws from the contract, the Seller must refund all payments received from the Buyer without delay and no later than 14 days from the day the Seller receives the Buyer’s notice of withdrawal.
b. The Seller will use the same payment method for the refund as was used in the original transaction, unless otherwise agreed with the Buyer.
c. The Buyer bears the direct costs of returning the handcrafted chickens.
d. The withdrawal period is not upheld if the Buyer takes possession of the handcrafted chickens after the withdrawal period has expired.

§ 6 Liability for Defects

If the handcrafted chickens are defective, the Buyer has the right to demand rectification, a price reduction, or to withdraw from the contract. The Seller may choose to remedy the defect by repair or replacement.

§ 7 Final Provisions

These GTC are governed by Swiss law. The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is the Seller’s place of business.

Please Note:

The handcrafted chickens are unique and may vary in shape, color, and size. The handcrafted chickens are not suitable for children under the age of 3. The handcrafted chickens should be stored in a dry and protected location.
